Danville, IN – More than a year after gunfire erupted at a Brownsburg neighborhood, the man responsible for the fatal shooting of 20-year-old Carlos Neri-Guzman has been sentenced.
A Hendricks County judge today sentenced Darrius Tolbert to 55 years in the Indiana Department of Correction for the March 5, 2024, murder that unfolded in broad daylight outside a neighborhood clubhouse while children were nearby.
Following a two-day jury trial, Darrius Tolbert—18 at the time of the shooting—was convicted of murder after prosecutors proved he was the instigator of the deadly encounter. Evidence showed Carlos Neri-Guzman had arrived at the clubhouse parking lot to meet Tolbert when Tolbert and co-defendant Jeremy Briscoe (15 at the time) approached his vehicle and opened fire within seconds.
Forensic evidence confirmed the fatal bullet that struck Neri-Guzman in the chest was fired by Tolbert. Despite being critically wounded, Neri-Guzman attempted to drive away before losing consciousness. His vehicle veered off the roadway and crashed into a home in the 10300 block of Memorial Knoll Drive, in the Eagle Crossing neighborhood near Eagle Crossing Drive, where he died at the scene.
During today’s sentencing, the court identified several aggravating factors, including Tolbert’s role as the instigator, the fact that the murder occurred at a neighborhood clubhouse and park where children were present, and his failure to accept responsibility while the investigation was underway.
Hendricks County Prosecutor Loren Delp said the sentence reflects accountability for a senseless act of violence.
